When you need to file a personal injury claim, there are several factors that claims adjustors will look at to determine the circumstances. Make sure to follow these points to have the best chances in resolving your personal injury claim favorably.
1. How quickly you contact your insurance company. Specifically for auto accident claims, this is very important. If you are capable, after an accident, contacting your insurance company should be the first thing you do.
2. The police report. Investigating officers' names, badge numbers, and details about the accident will be recorded after an accident. Police testimonial will be used to corroborate claims made by either party.
3. How fast you sought medical assistance. Like contacting your insurance company, this should be top priority. Based on the severity of injury, medical assistance may be required (and appropriate) before filing the claim. Medical reports and the Police records can back up what was necessary, so take care of your well-being first. Even if your injury seems minor, consult a physician to make sure you aren't injured in a non-obvious manner.
4. Pre-existing injuries/conditions. Check with your physician to make sure the accident isn't making pre-existing conditions aren't affected. Additionally, don't try to claim a pre-existing injury/condition on an accident claim. Medical records will show whether you had a condition before the accident and whether it deserves compensation in these new circumstances.
5. Criminal records. Should anything in your past present you as liable or prone to accident in your circumstances, you may have trouble getting compensation if you are the victim. Conversely, the perpatrator will could have a weaker defense pending their record.
6. Statements between involved parties. It's smart to keep comments to minimum after an accident. When you've been injured or witnessed an injury, emotions are running high and you probably won't be able to think clearly. Stay focused and don't try to lay blame or make promises. Verbal comments can cause unnecessary complications.
7. Any witness testimonies. If anyone is in the area of the accident, but not directly involved, they will be questioned and their statements will be recorded. Keep in mind point 6. You don't want to interfere with witness statements, which could be unfavorable in almost all circsumstances.
8. Photographs of scene. Usually, when the police are involved, photos will taken of the accident for evidence to be reviewed by the insurance company, medical professionals, and the court (if the claim goes that far).
